As Park City Mountain Resort and Vail Resorts work to settle their legal differences, Third District Court Judge Ryan Harris has officially signed and filed the Order of Restitution, evicting Park City Mountain Resort. That eviction has been stayed for now. KPCW's Leslie Thatcher has more.
Two weeks ago, Third District Court judge Ryan Harris ordered Park City Mountain resort and Vail Resorts into mediation to work out their differences with a deadline to have it resolved by August 15th. But given the secrecy of the negotiations, it'll be another month-and-a-half before the community finds out if they could do that. KPCW's Leslie Thatcher has this update.
Last Week in Third District Court, Judge Ryan Harris took up again the legal disputes broiling at the Sky Lodge. He told attorneys for the Homeowners Association that he would not agree - for now anyway - to have his court supervise an election for the HOA. The HOA claimed they need such an election to deal with challenges from the Sky Lodge's owner, Ken Abadalla. Rick Brough has more.
As we've reported, in a major omnibus ruling issued Wednesday, Third District Judge Ryan Harris ruled on nine motions in the lease dispute between Park City Mountain Resort and Talisker/Vail.
On virtually all issues, Judge Harris ruled in favor of Talisker Land Holdings, Vail Resorts, and their affiliates. In his 82-page opinion, the Judge laid down the history of the dipute, and the reasoning behind his decisions. Rick Brough has more.
Vail Resorts Wednesday won its Third District Court lawsuit against Park City Mountain Resort, which contended that PCMR failed to renew its lease on ski lands at the resort. The ruling on nine motions in the three-year old-case all favored Vail’s positions that PCMR’s lease is now expired. Vail has already served an eviction notice to PCMR, which has ignored the eviction.
Third District Court Judge Ryan Harris last week heard opposing arguments on another suspect of the legal war at the Sky Lodge, between Lodge owner Ken Abdalla and a group of unit owners. The lawsuit being discussed last week involves an owners group that says Abdalla's management company, Malibu, is diverting too much money from rental revenues due to the owners. But Abdalla's attorney says a small group is trying to usurp control of the Lodge and ruin Abdalla's business there. Rick Brough has more.
In the next couple of weeks, Third District Judge Ryan Harris is considering a large quantity of claims, allegations and legal arguments from both sides in the Park City Mountain Resort ski hill lawsuit.
In the past two weeks, the Judge heard oral arguments on three major disputes. Last week, the Mountain Resort - which had said it still has a valid lease of over 3,000 acres of its ski hill - said its lease was violated because the landlord, Talisker Land Holdings, in effect, sold the property to Vail Resorts.
