The Glenwood Cemetery Association was unsuccessful in a motion to Third District Court Thursday morning, which would have resolved a wrongful-death lawsuit filed against the Glenwood, involving a four-year-old boy who died when a headstone accidentally fell on him.
The attorney for the Glenwood Association contended that the parents of the victim, Carson Dean Cheney, had agreed to a financial settlement, then backed out of it. The Association asked Judge Ryan Harris to enforce the settlement agreement, but he ruled there were still issues of fact about it to consider. Rick Brough has more.
